When using the Platform or the services offered by TERAPPIA, users accept and submit to the conditions of these Terms and Conditions of use of the platform, as well as its Privacy Policy and Return Policies, as well as all documents attached thereto.

TERAPPIA's main objective is to register psychologists on its platform, with the purpose of collectively benefiting them through advertising made in digital and non-physical media, on behalf of the platform, and eventually individuals, such decision being exclusively up to the TERAPPIA administration, thus promoting it in this digital environment, making information on psychologists in their area of professionals visible to visiting users, enabling users to select professionals by free will and according to particular interests, without any kind of influence or control of the platform.

By subscribing to the platform, the Psychologist agrees to display their data entered on the platform through their registration, thus allowing them to be publicly disclosed through the THERAPPIA means of communication, during the period in which the subscription is in force.

TERAPPIA allows users to register on the consulting platform in accordance with the current regulation, with the purpose of dissemination with the sole objective of subletting these spaces to other professionals, including psychologists.

TERAPPIA allows users to use the search service for Psychologists registered on the platform, carried out through search filters, so that users have the possibility of accessing the information provided on the platform about registered professionals and thus establishing contact by digital means with these professionals for the purpose of agreeing psychotherapeutic treatment. Psychologists subscribing to the platform agree that THERAPPI does not influence or direct users/clients to professionals, as this is a choice of total free will of these users/clients, which is independent of the platform in any way. In this way, TERAPPIA allows any user to access the list of Psychologists registered on the platform, thus enabling digital contact between interested parties, which both agree.

ABOUT ADVISORY ADVISORY SERVICES

TERAPPIA offers any person, owner or lessor of space intended for the work of psychologists, to publish an individual advertisement on the platform, solely for their own space, for the purpose of subletting it to other professionals.

Each advertiser will have an individualized space that will present the data inserted in the registration, thus, the advertiser agrees with the open and public disclosure by the TERAPPIA means of communication of this information, by accepting these Terms of Use. All fields are informed by the interested advertiser. in registering your space in TERAPPIA, and published on the platform automatically after sending the information, not allowing any type of subsequent claim to TERAPPIA.

TERAPPIA allows psychologists to use the search service for offices for sublease that are registered on the platform so that there is the possibility of contacting these advertisers in order to agree on the lease or sublease of the advertised space.

TERAPPIA does not carry out any kind of intermediation in the negotiation between the parties and is not responsible for any losses arising from negotiations between the psychologist and the advertiser. The psychologist interested in the lease or sublease does not need to be registered with TERAPPIA to be able to contact advertisers, therefore, the advertiser agrees that the disclosure of all information contained in the advertisements is freely exposed so that any interested person can read it, with the sole purpose of publicizing your practice. The advertiser will not be able to question the TERAPPIA or request other forms of presentation of information related to his practice on the platform.

ABOUT THE REGISTRATION OF PSYCHOLOGISTS

The professional interested in registering as a Psychologist at TERAPPIA must be aware that the minimum condition is to have a complete higher education in Psychology, be over 18 years old, be duly registered and regularized with the Federal Council of Psychology and the Regional Council of the jurisdiction where operates, and be able to perform online consultations through the E-PSI system, which is part of the official website of the Federal Council of Psychology. By accepting these terms of use, the Psychologist declares that he is aware of the obligation to have his registration active with the Regional Council of Psychology and to have authorization in the e-psi so that he can serve clients in the online modality, and that in the absence of one of these, he will respond individually , for administrative and legal sanctions with the competent bodies, without the involvement of TERAPPIA.

In case of suspected fraud, the Psychologist may be questioned until everything is proven and clarified, and otherwise, TERAPPIA reserves the right to exclude the Psychologist from the platform without the need for prior communication or acknowledgment by the Psychologist, disabling the registration and preventing any future registrations linked to them.

TERAPPIA is not responsible for updating data, especially the cell phone number, which, if not updated, will make it impossible for users to contact the Psychologist. It is the Psychologist's sole responsibility to update their registration in TERAPPIA, through access to the user's administration area or by request to the means of communication available at the time. In case of identification of an outdated registration, the Psychologist may be contacted by email to provide their updated data, and if there is no response, THERAPPIA will inactivate the registration without prior notice. TERAPPIA reserves the right to contact registered Psychologists at any time, to request relevant data and/or documentation in order to legitimize the veracity of the data so that the registration on the platform is allowed to continue.

Psychologists, during the term of the subscription to the platform, have the right to access, correct, update or delete their personal data on the platform, as well as request the total deletion of their data, in accordance with the rules for requesting registration exclusion present in this Term of Use. Thus, the psychologist agrees and assumes to be solely responsible for the data and images presented on the platform. In the event of any technical eventuality or failure to occur, which makes it impossible to update the platform's registration, TERAPPIA undertakes to provide adequate support and assistance to meet these requests.

ABOUT ADVERTISER REGISTRATION

Professionals interested in registering their lease or sublease advertisement in THERAPPIA must be aware that the minimum condition is to be over 18 years of age and to be the owner or tenant of a space intended exclusively for the use of Psychologists. Other types of service spaces for professionals from other areas will not be accepted. If TERAPPIA identifies any violation of these rules, it may delete the registration immediately and without the need for prior notice or awareness of the advertiser, disabling the existing registration and preventing any future registrations linked to them.

The advertiser agrees that he will not have any tool to manage his data entered for the advertisement on the platform, being necessary to request to TERAPPIA, through the communication channel available at the time, any necessary changes or registration updates, such as description of services and registered telephone number .

TERAPPIA is not responsible for updating data, especially the cell phone number, which, if not updated, will make it impossible for psychologists to contact the advertiser. It is the sole responsibility of the advertiser to update the registration with TERAPPIA, by request to the means of communication available at the time. In case of outdated registration identification, the advertiser may be contacted by email to provide their updated data, and if there is no response, TERAPPIA may inactivate the ad without prior notice to the advertiser. TERAPPIA reserves the right to contact registered advertisers at any time to request relevant data and/or documentation in order to legitimize the veracity of the data so that the advertisement can continue on the platform and the non-presentation of the requested data or documents entitles TERAPPIA to inactivate the ad without prior notice to the advertiser.

ABOUT CHARGES

In order for TERAPPIA to maintain the costs of maintaining and improving the platform, in addition to bearing its administrative expenses, TERAPPIA will request the payment of an annual fee for registering the psychologist or advertiser, the aforementioned fee being informed through the means of communication available and previously to the interested psychologist or advertiser, if applicable, before the registration is carried out and which may vary according to criteria and exclusive services offered by TERAPPIA. TERAPPIA does not charge registered psychologists any fee or amount on sessions held and/or scheduled with its clients, not even in relation to its advertisers, related to the leasing or subleasing of spaces. For patients who access the website or application, THERAPPIA does not charge any amount or fee for using the platform. However, TERAPPIA reserves the right to change its policies of values and application of fees at any time, without obligation of consent or prior notice, on all its users, updating these terms of use, and its users, when continuing to use of the platform from any change in these terms of use, agree with any changes in the platform's billing system.

ABOUT THE PSYCHOLOGISTS AND ADVERTISING SEARCH TOOL

TERAPPIA, through its platform, offers any user of its services the functionality to search for Psychologists, through search filters arranged and used on the platform, which is associated with the data present in the profiles of registered professionals, to that can be located through this search engine carried out by the user of the site. According to the configuration applied by the user to the search filters, a list with the Psychologists that meet the requirements of the used configuration will be presented. The order of presentation of professionals is random and determined by the platform construction algorithm, and any user of the platform is not allowed to request any type of change in the order of presentation of Psychologists.

When searching for advertisements for lease or sublease of spaces, the interested psychologist can use the search service by name of the establishment or by state, and according to what is typed, a list of advertisements for spaces will be presented. The order of presentation of the offices is in order of registration, with the last registered being presented first, and so on, and any user of the platform is not allowed to request any type of change in the order of presentation of the offices.

The user, when interested in the researched Psychologist, must click on the contact button corresponding to the Psychologist of interest, and thus will be directed to the instant messaging application “WhatsApp Messenger”. From that moment on, negotiation is carried out directly with the Psychologist, and the latter becomes fully responsible for the relationship between client and psychologist, and thus, THERAPPIA is exempt from any responsibilities in any respect in the relationship between patient and Psychologist subsequent to the choice of the professional by the platform by the user, however, user complaints sent through the platform's contact channel will be analyzed, and THERAPPIA has the right to analyze what happened, as well as to contact the Psychologist involved for clarification, if deemed necessary.

In the same way, the advertising space for leasing and subleasing works, where the psychologist interested in a space must click on the contact button corresponding to the advertisement of interest, and thus be directed to the instant messaging application “WhatsApp Messenger”. From that moment on, the negotiation is carried out directly with the advertiser, and the latter becomes fully responsible for the negotiation between the psychologist and the advertiser, and thus, TERAPPIA disclaims any responsibility in any way in the negotiation between the parties, however, claims of psychologists sent through the contact channel will be analyzed and TERAPPIA has the right to contact the advertiser involved for clarification, if it deems necessary.

TERAPPIA does not oppose any attempt to make contact between users and registered Psychologists by other external means, however, once again, TERAPPIA disclaims any responsibility for the relationship established between Psychologists and users. TERAPPIA does not have access to any information arising from the relationship established between the user and their Psychologist, and disclaims any responsibility for irregularities committed by registered Psychologists, should they occur.

In the same way, the advertising space for leasing and subleasing works, where TERAPPIA does not oppose any attempt to make contact between psychologists and advertisers by other external means, and once again, TERAPPIA disclaims any responsibilities for agreements signed between advertisers and psychologists. TERAPPIA does not have access to any information arising from the relationship established between the agreement or contract signed between the advertiser and the Psychologist, thus disclaiming any responsibility for irregularities committed between the parties involved in whatever type of agreement.

TERAPPIA does not guarantee, under any circumstances, that the registered Psychologists will be chosen by its users, nor does it guarantee the return on the investment made by the registered Psychologist, as it is a free will choice of the user, where particular and personal interests are decisive for choosing a professional, variables over which THERAPPIA has no domain, control or any type of responsibility or influence. In this way, the registered Psychologist understands and agrees that there is no way to challenge or question the platform on this aspect or make any accusations or allegations due to the lack of contacts received by the platform from visiting users.

Likewise, TERAPPIA also does not guarantee, under any circumstances, that registered advertisers will have their advertisements chosen by psychologists, nor does it guarantee return on investment, if applicable, as it is a choice of free will by the user, where particular interests and personal are determinant for the choice of a space for leasing or subleasing, variables over which TERAPPIA has no domain, control or any type of responsibility or influence. Thus, the registered advertiser understands and agrees that there is no way to challenge or question the platform on this aspect or make any accusations or allegations due to lack of contacts received by the platform from visiting or registered Psychologists.

ABOUT THE RESPONSIBILITIES OF THE PSYCHOLOGIST

Although TERAPPIA is not responsible for the services provided, every registered Psychologist, in addition to the other obligations set forth in this document, the Psychologist agrees that he/she must:

Maintain satisfactory ethical and technical quality with their patients regarding the provision of their services;
Be duly regular before the Regional Council of Psychology in your area of operation, as well as your authorization in the E-PSI, which allows the Psychologist to exercise online assistance;
Keep registration in TERAPPIA updated;
Ensure and guarantee the security, storage and secrecy of information, reports and any other documents of its clients, through its own methods, whether physical or technological, preventing access, sharing and misuse of this data by any other people;
Comply with the determinations of the Federal Council of Psychology (CFP) regarding the custody of documents, medical records and notes taken during consultations for a minimum period of 5 (five) years, which may be extended by express legal or judicial determination or , also, in specific cases where maintenance is required for a longer period;
Not allow AntiSpam systems or e-mail settings to prevent the receipt of communications from TERAPPIA, no excuses being accepted in case of non-receipt of communications and electronic messages sent by TERAPPIA;
Respect all intellectual property rights owned by THERAPPIA;
The registered Psychologist agrees to respect all the conditions present in this term, as well as the other communications and guidelines sent later by THERAPPIA;
In the event of any type of damage to the platform or to third parties, resulting from misuse of the platform or through irregular acts committed by the registered Psychologist, as well as any other acts or omissions that may harm the THERAPY or third parties, it will be up to the Psychologist bear all legal obligations to indemnify TERAPPIA or the injured party, assuming all relevant legal issues, as well as procedural costs and expenses, including lawyers' fees, excluding TERAPPIA from any type of legal or financial loss or burden;
The platform's functionalities are offered in the form of a service during the term of the subscription, in accordance with the rules established in these Terms of Use, not granting the Psychologist any rights over the software related to the platform or over its structures of informatics that support it;
TERAPPIA directs that Psychologists should guide their conduct following the Code of Professional Ethics for Psychologists, available on the website of the Federal Council of Psychology, whose access link appears on the main page of the TERAPPIA website;
Psychologists agree to use the THERAPPIA platform responsibly and ethically, not sharing false or misleading information, not using the platform for illicit or unethical practices, or even denigrating it or practicing slanderous acts, and respecting copyright and copyright intellectual property of the platform.

ABOUT ADVERTISER RESPONSIBILITIES

Although TERAPPIA is not responsible for negotiations and contracts made between advertisers and psychologists, in addition to the other obligations set forth in this document, the advertiser agrees that it must:

Maintain satisfactory ethical and technical quality with tenant psychologists regarding the provision of their services;
Keep working and living spaces sanitized;
Keep registration in THERAPPIA updated;
Ensure and guarantee the security, storage and secrecy of information, contracts and any other documents relating to its renting psychologists, by their own methods, whether physical or technological, preventing access, sharing and misuse of this data by any other persons;
Not allow AntiSpam systems or e-mail settings to prevent the receipt of communications from TERAPPIA, no excuses being accepted in case of non-receipt of communications and electronic messages sent by TERAPPIA;
Respect all intellectual property rights owned by THERAPPIA;
The advertiser agrees to respect all the conditions present in this term, as well as the other communications and guidelines sent later by TERAPPIA;
In the event of any type of damage to the platform or to third parties, resulting from misuse of the platform or through irregular acts committed by the advertiser, as well as any other acts or omissions that may harm TERAPPIA or third parties, the advertiser will be responsible for with all legal obligations to indemnify TERAPPIA or the psychologist or injured user, assuming all pertinent legal issues, as well as procedural costs and expenses, including lawyers' fees, excluding TERAPPIA from any type of legal or financial loss or encumbrance;
The platform's functionalities are offered in the form of a service during the term of the subscription, not granting the advertiser any rights over the software related to the platform or over its IT structures that support it.

ABOUT USER RESPONSIBILITIES

Although TERAPPIA is not responsible for users visiting the platform, they, when using the services provided by TERAPPIA, in addition to the other obligations set forth in this document, agree that:

Recognize and agree that TERAPPIA is not responsible for any inappropriate or illegal conduct by any Psychologist registered on the platform, or any other user of the platform;
Recognize and agree that TERAPPIA has no control over the quality, safety or legality of the services provided by psychologists registered on the platform, nor does it guarantee the veracity or accuracy of the information provided by them;
Acknowledge and agree to exempt TERAPPIA, its administrators, directors, employees, agents and affiliates from any claims, damages and liabilities arising from or related to the use of services provided by Psychologists registered on the platform;
Respect all intellectual property rights owned by THERAPPIA;
In the event of any type of damage to the platform or to third parties, resulting from misuse of the platform or through irregular acts committed by the user, as well as any other acts or omissions that may harm THERAPPIA or third parties, it will be up to the user to bear with all legal obligations to indemnify TERAPPIA or the injured subject or Psychologist, assuming all relevant legal issues, as well as procedural costs and expenses, including lawyers' fees, excluding TERAPPIA from any type of legal or financial loss or burden;
The platform's functionalities are offered to the user in accordance with the rules established in these Terms of Use, not granting the user any rights over the software related to the platform or over its computer structures that support it;
Users agree to use the TERAPPIA platform in a responsible and ethical manner, not sharing false or misleading information, not using the platform for illicit or unethical practices, or even denigrating it or practicing slanderous acts, and respecting copyright and copyright. intellectual property of the platform.

ABOUT THE RESPONSIBILITIES OF THE THERAPY

TERAPPIA undertakes to maintain the confidentiality of the information provided by Psychologists, advertisers and users registered on the platform, in accordance with the Privacy Policy present on the platform.

TERAPPIA undertakes to carry out disclosures through advertisements on the available communication channels and which it deems appropriate, with a frequency solely defined by the platform administration, with Psychologists or advertisers not being responsible for any type of questioning, claim, demand for results or request for data. statistics, and this information is only forbidden to TERAPPIA. Psychologists and advertisers agree that TERAPPIA cannot guarantee any type of result, measurable or not, as a result of its advertisements, regardless of their frequency, type of channel used or any other form.

TERAPPIA is responsible for publishing on its platform, within 24 working hours, the profiles of its registered Psychologists upon confirmation of subscription payment, regardless of the payment method used offered by TERAPPIA.

TERAPPIA is responsible for sending information it deems relevant to its Psychologists, advertisers and users, through the means of communication it deems appropriate and available.

TERAPPIA is not responsible for the quality of services provided by Psychologists registered on the platform, nor for the content disclosed by them, these being the sole responsibility of the Psychologist. The platform is also not responsible for the inappropriate or illegal use of user data by third parties.

TERAPPIA is not responsible for inspection, maintenance, quality, hygiene and any other characteristics presented by the advertised offices, which are the sole responsibility of their advertisers.

The platform reserves the right to cancel the registration of any Psychologist, advertiser or user who fails to comply with the rules established in these Terms and Conditions of Use or who exhibits inappropriate, unethical or criminal behavior, depending on the assessment of the platform administrators , complaint to the Regional Council of Psychology of the region where the offending Psychologist is registered.

ON COMPLIANCE WITH RULES, LAWS AND EXEMPTIONS

TERAPPIA does not have any management or influence of any kind on schedules, contracts, payments and the treatment itself, with registered Psychologists and advertisers being solely responsible for the veracity and accuracy of their information, documents, contents and amounts to be charged for your consultations, which is regulated by the Federal Council of Psychology, as well as its working methods, so that TERAPPIA is exempt from any liability due to cancellation, delay, change of date or time of consultation, lease or sublease or any other moral or material damage to the user.

TERAPPIA complies with all rules, laws and guidelines applicable to the type of activity it performs, however, it is not responsible for non-compliance with the same by registered users, advertisers and psychologists. When using the services offered by TERAPPIA, the user, advertiser or psychologist, agrees with the PRIVACY POLICY, as well as the SITE POLICY, TERMS AND CONDITIONS OF USE, and DELIVERY, EXCHANGE, RETURN AND REFUND POLICY, whose links are in the footer of the website pages, being responsible for compliance with any and all laws, rules, regulations and legal and tax obligations that may be due for the use of TERAPPIA services.

Although TERAPPIA reserves the right to analyze, verify or monitor the registration information of psychologists, users and advertisers of the platform, TERAPPIA is not obliged to do so or guarantee the accuracy or authenticity of the information provided, and the competent bodies are responsible for such checks. However, TERAPPIA, in order to maintain the quality of its registered professional psychologists, may verify, through a third-party service, academic veracity, professional consultation or virtual reputation, but without obligation to do so.

TERAPPIA's website and mobile application may contain links with advertisements to other sites, however TERAPPIA has no relationship of any kind with these other institutions, not being responsible for any damages, purchases, sales or any other type of burden or bonus that cause to its users, as well as its policies are not applicable in these cases. The user is fully responsible for the risks of accessing these third-party sites served on TERAPPIA.

The registered Psychologist, user or advertiser agrees that TERAPPIA does not assume any responsibility for any technical difficulty, bugs, connection drop, system failures, viruses or trojans or any type of defects or damages occurred in the computational or telephony resources of the users or of third parties that may have occurred due to the use of the platform, as well as costs related to expenses with mobile telephony, being the sole responsibility of the THERAPPIA user.

If the platform goes offline, or is unable to be used, however long the period may be and for whatever reason, no registered psychologist, user or advertiser may require THERAPPI to reactivate it or even any type of compensation or compensation for damages during the period the website or application is offline, regardless of the reason.

Any changes in the characteristics or form of operation of the website or mobile application, caused by force majeure, must be interpreted and understood by users as an attempt to solve problems by TERAPPIA, not being entitled to claims or claims.

If required by any government agency or judicial authority, TERAPPIA has the right to cooperate with any type of investigation, and may, at any time, provide available information from registered psychologists or advertisers, and all Psychologists, advertisers and users agree that there is no any possibility of preventing the provision of this information to such bodies or authorities.

ABOUT COPYRIGHT AND PROHIBITIONS

No Psychologist, advertiser or user is allowed to copy, adapt, sell, reproduce, license or publish data or any other information produced by TERAPPIA and published on the website or application, for any purpose in any means of communication not authorized by TERAPPIA, in whatever the modalities, whether online or offline. If such type of infringement or reproduction of TERAPPIA content is found in any other type of unauthorized means of communication, TERAPPIA will demand copyright, as well as hold the author legally responsible for such undue acts, subject to the sanctions provided for by law.

Likewise, Psychologists who are authors of articles must cite sources, when using materials produced by other authors, Psychologists being solely responsible for the content published in article format on the platform, and any violation of copyright, the Psychologist will be held responsible in full and will respond in accordance with copyright laws.

In TERAPPIA, Psychologists can produce materials through the tools developed and offered by the platform to professionals, with the purpose of allowing TERAPPIA to use these materials for dissemination in the applicable media and defined by the sole discretion of the platform. The Psychologists agree, through these Terms of Use, that all material created by the user of the platform, becomes the entire domain of TERAPPIA, its use being free and unrestricted, regardless of whether or not the Psychologist's signature on the platform is in force. The Psychologist agrees that THERAPPIA has full and total exercise rights regarding the use of materials created by professionals for the purpose of dissemination, including also the right to eliminate or delete the material. The Psychologist who created the content is not prohibited from sharing, disclosing or using his own materials in any means of communication, during the term of the subscription or even after the platform services are terminated, due to the end of the subscription period or any other reason.

THERAPPIA is protected by intellectual property laws and other applicable laws. Psychologists, advertisers and users agree to respect such laws and not to copy, reproduce, modify or create derivative works based on the platform, the application or any part of the services offered by TERAPPIA. Unauthorized use of platform exclusive materials may result in violation of copyright, trademark, privacy and publicity and other applicable laws.

ABOUT THE PSYCHOLOGIST OR ADVERTISER'S REGISTRATION CANCELLATION

The Psychologist or advertiser agrees by these Terms of Use of the Platform, that the amount paid to TERAPPIA refers to the registration and registration of the professional on the platform for a period of 1 year, where he can enjoy the services offered in accordance with the benefits package in validity.

Psychologists and advertisers registered on the platform may request TERAPPIA to delete their registration at any time, however, the Psychologist or advertiser agrees that the registration exclusion procedure in TERAPPIA will not reimburse the total amount and not even the proportional amount of the annuity, for the remaining months or days referring to the amount paid by the psychologist or advertiser, and therefore, the demand for reimbursement by the psychologist or advertiser will not apply, regardless of the payment method used.

However, in accordance with article 49 of the Consumer Defense Code (CDC), the Psychologist or advertiser may request withdrawal of the subscription, within 7 days from the start of the platform subscription term, and thus, the THERAPPIA refund the full value of the product purchased.

If any Psychologist or advertiser is excluded from the platform, at the initiative of TERAPPIA, for reasons subject to exclusion, signed and accepted in these Terms of Use, TERAPPIA will not reimburse any amount paid, proportional or not to the annual subscription period carried out by the Psychologist or advertiser. TERAPPIA is also not obliged to make any communication, notice or request prior consent to the Psychologist or advertiser excluded from the platform, for non-compliance with the rules contained in these Terms of Use.

ABOUT USER SUBSCRIPTION RENEWAL

As previously mentioned in this document, TERAPPIA charges its users an annual fee for registering psychologists on the platform, and that this guarantees the validity of 12 (twelve) full months of subscription and permanence on the platform, counted from the online publication of the profile of the psychologist in TERAPPIA. Except for the occurrence of registration exclusion, for the reasons mentioned in this document, on the eve of the end of the 12 (twelve) months, THERAPPIA will communicate with the registered psychologist, with the objective of consulting him and knowing if there is interest in renewing his subscription with the THERAPPI, as there is no form of automatic renewal in our systems. If the psychologist is interested, THERAPPIA will guide the professional at each stage until the renewal procedure is completed, where the psychologist will remain for another 12 (twelve) months.

In the event that there is no response from the professional when consulted by TERAPPIA about the interest in renewing the subscription, the professional's registration will be discontinued from the platform on the date the subscription expires and the psychologist will not be responsible for any questions about such platform action. Even so, the subscription can be renewed and the profile will be reactivated on the platform only when all publication procedures are completed, including the completion and confirmation of payment of the annuity.

TERAPPIA reserves the right to unilaterally evaluate the conduct of the professional during the subscription period, as well as the right to opt for the non-renewal of a certain professional, in case TERAPPIA concludes and decides not to be interested. In this case, it will not be up to the psychologist to know the reason or ask any questions, or even try to create an appeal or justification to reverse the THERAPPI's decision, leaving only the registration exclusion of the psychologist, without the right of future return, regardless of the time elapsed between the exit and a possible interest of re-entry on the part of the psychologist.

ABOUT THE CONTACT CHANNELS

TERAPPIA offers its users a contact channel for sending questions, suggestions, complaints or complaints. TERAPPIA is not obliged to respond to all requests from its users, however, all information will be analyzed in order to seek clarification or assess the veracity, investigating facts and taking appropriate measures. TERAPPIA requests, in its contact form, data such as NAME, SURNAME, TELEPHONE AND E-MAIL, used only for the user who made the contact to receive his response, and in this way, the user is in full agreement to provide such information to that purpose.

ABOUT THE TERMS OF USE

These Terms of Use constitute the entire agreement between TERAPPIA and the users of the platform, and supersede any previous agreements or understandings, whether oral or written, related to the subject. If any provision of these Terms of Use is held to be invalid or unenforceable, such provision will be deleted or limited to the minimum extent necessary for these Terms of Use to remain in full force and effect. The failure of TERAPPIA to exercise or enforce any right or provision of these Terms of Use immediately will not constitute a waiver of TERAPPIA to exercise such right or provision.

Platform users agree that any dispute arising out of or related to these Terms of Use or the use of the platform will be governed by the jurisdiction of the Judicial District of the Capital of the State of Rio de Janeiro to resolve any issues arising from these Terms of Use, with express waiver of any another, however privileged it may be or may have or may have, and waiving any other jurisdiction to which it may be entitled by domicile or any other reason.

In case of doubts about the Terms and Conditions of Use, platform users can contact TERAPPIA through the communication channels available on the platform.

11 - SOBRE AS RESPONSABILIDADES DO TERAPPIA

11.1 - O TERAPPIA se compromete a manter a confidencialidade das informações prestadas pelos Psicólogos, anunciantes e usuários cadastrados na plataforma, de acordo com a Política de Privacidade presente na plataforma.

11.2 - O TERAPPIA se compromete a realizar divulgações por meio de propagandas nos canais de comunicação disponíveis e que julgar adequados, com periodicidade unicamente definida pela administração da plataforma, não cabendo a Psicólogos ou anunciantes qualquer tipo de questionamento, pleito, exigência de resultados ou solicitação de dados estatísticos, sendo estas informações unicamente vedadas ao TERAPPIA. Os Psicólogos e anunciantes concordam que o TERAPPIA não pode garantir nenhum tipo de resultado, mensurável ou não, por efeito de suas propagandas, independentemente de sua frequência, tipo de canal utilizado ou qualquer outra forma.

11.3 - O TERAPPIA se responsabiliza em publicar em sua plataforma, em até 24 horas úteis, os perfis de seus Psicólogos cadastrados mediante a confirmação do pagamento da assinatura, independente da forma de pagamento utilizada oferecida pelo TERAPPIA.

11.4 - O TERAPPIA se responsabiliza pelo envio de informações que julgar pertinentes, aos seus Psicólogos, anunciantes e usuários, pelos meios de comunicação que julgar adequados e disponíveis.

11.5 - O TERAPPIA não se responsabiliza pela qualidade dos serviços prestados pelos Psicólogos cadastrados na plataforma, nem pelo conteúdo divulgado por eles, sendo estes de responsabilidade única do Psicólogo. A plataforma também não se responsabiliza pelo uso inadequado ou ilegal dos dados dos usuários por terceiros.

11.6 - O TERAPPIA não se responsabiliza pela fiscalização, manutenção, qualidade, higiene e quaisquer outras características apresentadas pelos consultórios anunciados, sendo estas de responsabilidade única de seus anunciantes.

11.7 - A plataforma se reserva ao direito de cancelar e excluir o cadastro sem obrigação de consentimento ou aviso prévio, de qualquer Psicólogo, anunciante ou usuário que descumpra com as normas estabelecidas nesses Termos e Condições de Uso ou que apresente comportamento inadequado, impróprio, antiético ou criminoso. No caso de Psicólogos, caberá, de acordo com a avaliação unilateral dos administradores da plataforma, denúncia ao Conselho Regional de Psicologia da região onde o Psicólogo infrator estiver inscrito.

12 – SOBRE OS CONVÊNIOS COM EMPRESAS

12.1 – O Terappia também oferece aos seus psicólogos a possibilidade de atendimento à clientes cadastrados vindos através de empresas conveniadas ou parceiras do Terappia, que oferecem a Plataforma como benefício aos seus colaboradores.

12.2 – Apenas os psicólogos inscritos na plataforma poderão aderir aos atendimentos à clientes vindos de empresas conveniadas ou parceiras do Terappia. Dessa forma, os psicólogos que desejarem participar desta modalidade de atendimento, concordam e dão ciência de que esta decisão se dá por livre e espontânea vontade, reconhecendo que a adesão a esta modalidade não é obrigatória, apenas configurando uma oportunidade de expansão das possibilidades de atendimento na plataforma, e assim concordam com estes termos estabelecidos neste documento.

12.3 - O psicólogo que tiver interesse em atender clientes de empresas conveniadas, deverá acessar a sua área de usuário, na seção “Atualização cadastral” e configurar o seu perfil para esta finalidade, conforme instruções contidas na própria seção citada e dispostas no Manual do Terappeuta, bem como as normas e regras informadas na própria página citada, assim dando ciência e concordando com estes termos de adesão.

12.4 - As empresas conveniadas ou parceiras poderão oferecer a plataforma com subsídio total ou parcial das consultas aos seus colaboradores. A forma de contratação realizada entre a empresa conveniada ou parceira e o Terappia, poderá afetar algumas condições deste termo, contudo, todas as alterações serão previamente informadas aos psicólogos pelo Terappia.

12.5 – O Terappia será responsável por realizar toda a gestão da relação entre as empresas conveniadas ou parceiras e a plataforma, bem como a gestão de pagamentos aos psicólogos da plataforma.

12.6 – Durante todo o período contratual firmado entre o Terappia e as empresas conveniadas ou parceiras e enquanto estas estiverem oferecendo tais serviços em formato de benefício a seus colaboradores, toda comunicação e gestão do benefício será realizada entre o Terappia e a empresa conveniada ou parceira, e jamais haverá participação ou envolvimento do psicólogo nessa relação.

12.7 – O psicólogo aceita, concorda e reconhece que não pode estabelecer qualquer tipo de comunicação direta com a empresa conveniada ou parceira, ou com seus colaboradores, exceto nos termos estabelecidos nestes Termos de Uso. Assim, o psicólogo não tem permissão para realizar qualquer forma de comunicação, publicidade ou ações de marketing dos seus serviços diretamente aos colaboradores e pessoas associados à empresa conveniada ou parceira.

12.8 - O psicólogo poderá configurar o seu perfil de modo a sair da modalidade de atendimento a empresas conveniadas ou parcerias a qualquer momento, desde que esteja sem nenhuma pendência em relação ao Terappia, que sejam financeiras ou de quaisquer ordens. Caso seja verificada qualquer tipo de pendência citada, o psicólogo deverá continuar os atendimentos às empresas conveniadas ou parceiras, até que todas as pendências sejam regularizadas, independentemente da configuração feita pelo próprio, em seu perfil. Dessa forma, prevalecerão estes Termos de Uso sobre qualquer configuração feita na área de usuário do psicólogo.

12.9 – Nessa modalidade de atendimento a empresas conveniadas ou parcerias, o Terappia receberá o valor integral das consultas realizadas pelos psicólogos e fará o repasse de acordo com estes termos. O prazo para pagamento dos valores repassados aos psicólogos, poderá variar de acordo com as especificações de cada contrato com as empresas, podendo levar de 10 a 20 dias úteis após o encerramento de cada mês.

12.10. Em alguns tipos de contratos, o Terappia poderá solicitar ao psicólogo o envio de informações comprobatórias sobre a execução das sessões, para que o pagamento seja realizado. Dessa forma, caso esta cláusula se aplique, o psicólogo terá 10 dias úteis para o envio das informações solicitadas pelo Terappia. Em caso de não envio das informações, o psicólogo poderá não receber os valores pagos no prazo estimado para o pagamento.

12.11 – Os psicólogos reconhecem e concordam que em determinadas situações, se aplicável, o Terappia poderá realizar o desconto de impostos e tributos aos valores pagos aos psicólogos. Nesses casos, o Terappia fará comunicado prévio aos psicólogos para informar sobre tais condições.

12.12 – No caso de participação dos atendimentos por convênios e parcerias, é obrigatória a atualização cadastral do psicólogo, realizada através do acesso ao menu de usuário, onde o psicólogo se obriga a inserir o tipo de chave PIX e uma chave PIX válida vinculada ao psicólogo e titular da conta bancária. É de responsabilidade total do psicólogo prover somente informações e dados verdadeiros, exatos e autênticos, e a mantê-los atualizados enquanto estiver utilizando a plataforma, sob pena de não receber os valores devidos. Caso seja confirmado pelo Terappia que houve cadastro de informação incorreta, o psicólogo não terá direito a nenhum tipo de reclamação posterior ou restituição de qualquer tipo de valor.

12.13 – Quanto à duração das sessões, cada sessão realizada pelos psicólogos aderentes aos atendimentos às empresas conveniadas e parcerias, terá uma duração obrigatória de 45 (quarenta e cinco) minutos.

12.14 – No caso de uma empresa conveniada ou parceira subsidiar integralmente o pagamento das sessões para seus colaboradores, será permitido apenas que cada colaborador realize 1 (uma) sessão por semana, independentemente se forem 4 (quatro) ou 5 (cinco) sessões dentro do mesmo mês, para que se mantenha a continuidade dos atendimentos.

12.15 - Tanto o psicólogo quanto o cliente têm o direito de cancelar ou solicitar o reagendamento de uma sessão, desde que seja feito com um prazo limite de 24 (vinte e quatro) horas de antecedência em relação ao horário agendado, a fim de evitar a cobrança sem a realização da sessão.

12.16 – Após o agendamento, caso o cliente não compareça à sessão no horário marcado sem cumprir com as regras de cancelamento ou remarcação do item 12.15, não será restituída qualquer quantia à empresa e a cobrança será efetuada, e o psicólogo receberá pelo valor da sessão.

12.18 – Após o agendamento, caso o psicólogo não compareça à sessão no horário marcado sem cumprir com as regras de cancelamento ou remarcação do item 12.15, o psicólogo não receberá pelo atendimento, e a empresa contratante não será cobrada.

12.19 - A ausência não justificada do psicólogo à sessão, sem cumprir com as regras de cancelamento ou remarcação do item 12.15, poderá levar ao cancelamento ou suspensão temporária ou definitiva do psicólogo em relação aos atendimentos às empresas conveniadas ou parceiras, sendo esta uma decisão unilateralmente tomada pela administração do Terappia, sem obrigatoriedade de justificar ou comunicar ao psicólogo sobre tal decisão.

12.20 - Fica expressamente descrito e acordado que a adesão do psicólogo na modalidade de atendimento às empresas conveniadas ou parceiras não estabelece ou configura qualquer forma de vínculo empregatício com a plataforma Terappia ou com a empresa conveniada ou parceira, de acordo com as leis previstas na Consolidação das Leis Trabalhistas (CLT).

12.21 - O psicólogo atuará de forma autônoma, responsabilizando-se por todos os encargos fiscais, previdenciários e trabalhistas decorrentes de sua atuação junto aos atendimentos às empresas conveniadas ou parceiras, conforme a legislação vigente.

12.22 – Para o psicólogo que aderir ao atendimento às empresas conveniadas ou parceiras, não há obrigatoriedade de exclusividade, e o psicólogo poderá prestar seus serviços a outras entidades ou pessoas de quaisquer naturezas.

13 - SOBRE O COMPARTILHAMENTO DE CONTEÚDOS NAS REDES SOCIAIS PELO TERAPPIA

13.1 - Por meio de uma parceria do TERAPPIA com profissionais da área de marketing, a nossa plataforma oferece a seus usuários um recurso complementar, cujo objetivo é estimular a interação entre os Psicólogos cadastrados e outros usuários nas redes sociais, estes que podem ser considerados clientes em potencial. Esse recurso complementar consiste na divulgação do trabalho individual e nunca de forma coletiva dos Psicólogos cadastrados no TERAPPIA, quando estes produzirem materiais publicados em redes sociais, de acordo com as regras previstas nestes Termos de Uso. Para garantir uma experiência consistente e justa para todos os usuários, é importante entender e cumprir as regras e diretrizes de compartilhamento de conteúdo estabelecidas abaixo:

13.2 - Rede social atualmente utilizada para o serviço: O Instagram, cujo website se apresenta em www.instagram.com atualmente é a rede social na qual o serviço do TERAPPIA de compartilhamento de publicações dos Psicólogos cadastrados opera. Nenhuma outra rede social será utilizada para essa finalidade, portanto, os Psicólogos não poderão questionar quanto ao uso unicamente desta rede social para o serviço oferecido. A escolha da rede social para o serviço em questão, se dá unicamente pela administração do Terappia, que poderá migrar a qualquer momento para outra rede social, se julgar pertinente. Caso isso ocorra, o TERAPPIA fará um pronunciamento para informar tal mudança.

13.3 - Compartilhamento de publicações individuais: O TERAPPIA oferece um serviço de compartilhamento de publicações individuais e nunca coletivas dos psicólogos cadastrados em nossa plataforma na rede social definida, conforme descrito no item anterior. Essa funcionalidade destina-se exclusivamente a destacar o trabalho e as contribuições individuais e nunca coletivas dos profissionais cadastrados. Como condições mínimas para a realização deste serviço, o Psicólogo deve ter um cadastro e perfil válido nesta rede social, e ao publicar um material no feed ou reels, que são funções específicas da rede social – as quais o Psicólogo tem a responsabilidade de conhecê-las – se faz obrigatória a marcação do perfil do Terappia, caso o profissional deseje ter o seu conteúdo compartilhado. A marcação do perfil, que é função oferecida por esta rede social, é de inteira responsabilidade do Psicólogo, no que tange ao conhecimento de como fazer tal marcação, quanto de marcar ao publicar algum conteúdo que tenha interesse que seja divulgado. Os psicólogos que não fizerem a marcação conforme orientado nestes Termos de Uso, não terão seus conteúdos compartilhados, bem como não serão compartilhados, conteúdos marcados nos Stories, sendo esta uma outra funcionalidade da rede social, que o Psicólogo tem a responsabilidade de conhecer e da qual não faz parte do escopo deste serviço. Os Psicólogos que não possuem cadastro nesta rede social, não poderão ter acesso a esse serviço do TERAPPIA, sem direito a nenhum tipo de compensação, reivindicação ou pleito pela não prestação do serviço por esse motivo.

13.4 - Não compartilhamento de publicações de empresas, clínicas ou terceiros: As publicações feitas por Psicólogos cadastrados com marcação do perfil do TERAPPIA, que contenham informações relacionadas a empresas, clínicas, terceiros ou outras pessoas ou entidades que não façam parte da plataforma TERAPPIA, não serão compartilhadas. À essa regra de não compartilhamento, inclui-se a exibição de logomarcas, nomes, endereços de empresas ou clínicas, contatos telefônicos que não sejam de uso exclusivo do profissional, outros perfis da rede social, clínicas ou outros profissionais, entre outros detalhes corporativos, que o TERAPPIA poderá julgar inadequado a qualquer momento, sem necessidade de aviso prévio ao Psicólogo cadastrado.

13.5 - Respeito às diretrizes de conteúdo: Todo o conteúdo dos Psicólogos que for compartilhado pelo TERAPPIA nas redes sociais, deve estar em conformidade com nossas diretrizes de conteúdo. Isso inclui respeitar as normas éticas da profissão de psicólogo, promover práticas responsáveis e não publicar conteúdo que viole os direitos autorais ou seja inadequado para um público geral. Caberá de forma única e exclusiva do TERAPPIA, sem direito à interferência do Psicólogo cadastrado, a análise deste conteúdo, e caso seja julgado inadequado, este não será compartilhado ou será excluído após publicação. O Psicólogo cadastrado entende que o TERAPPIA é isento de qualquer responsabilidade sobre o conteúdo publicado pelo Psicólogo cadastrado, sendo este, de inteira responsabilidade do Psicólogo, e caberá responder individualmente às medidas cabíveis, se houver.

13.6 - O não cumprimento destas diretrizes pode resultar na remoção do conteúdo compartilhado e na suspensão ou encerramento do serviço do TERAPPIA com o Psicólogo que violar repetidamente as políticas de publicação e compartilhamento de conteúdo.

13.7 - Ao utilizar a plataforma do TERAPPIA, o Psicólogo cadastrado concorda em respeitar e aderir a essas diretrizes de publicação e compartilhamento de conteúdo.

13.8 – O Psicólogo entende e concorda que, após a marcação do conteúdo conforme disposto no item 13.3, o compartilhamento será realizado pela equipe de marketing parceira dentro de um cronograma determinado por eles. O Psicólogo não pode exigir a postagem imediata ou definir prazos específicos para o compartilhamento, que ocorrerá conforme a disponibilidade da equipe de marketing.

14 - SOBRE O CUMPRIMENTO DE NORMAS, LEIS E ISENÇÕES

14.1 - O TERAPPIA não possui nenhuma gestão ou influência de qualquer ordem sobre os agendamentos, contratos, pagamentos e o tratamento em si, sendo os Psicólogos e anunciantes cadastrados os únicos responsáveis pela veracidade e exatidão de suas informações, documentos, conteúdos e dos valores a serem cobrados por suas consultas, sendo esta de regulação do Conselho Federal de Psicologia, bem como de seus métodos de trabalho, de forma que o TERAPPIA se exime de eventual responsabilidade em razão de cancelamento, atraso, mudança de data ou horário de consulta, locação ou sublocação ou qualquer outro dano moral ou material ao usuário.

14.2 - O TERAPPIA cumpre com todas as normas, leis e diretrizes aplicáveis ao tipo de atividade que exerce, contudo, não se responsabiliza pelo não cumprimento das mesmas por usuários, anunciantes e psicólogos cadastrados. Ao utilizar os serviços oferecidos pelo TERAPPIA, o usuário, anunciante ou psicólogo, concorda com a POLÍTICA DE PRIVACIDADE, bem como a POLÍTICA DO SITE, TERMOS E CONDIÇÕES DE USO, e POLÍTICA DE ENTREGA, TROCA, DEVOLUÇÃO E REEMBOLSO, cujos links constam no rodapé das páginas do site, sendo responsável pelo cumprimento de todas e quaisquer leis, normas, regulamentos e obrigações legais e fiscais que possam ser devidas pelo uso dos serviços do TERAPPIA.

14.3 - Embora o TERAPPIA se reserve no direito de analisar, verificar ou monitorar as informações de cadastro de psicólogos, usuários e anunciantes da plataforma, o TERAPPIA não tem obrigatoriedade de fazê-lo ou garantir a exatidão ou autenticidade das informações prestadas, cabendo aos órgãos competentes, tais verificações. Contudo, o TERAPPIA, para manter a qualidade de seus profissionais psicólogos cadastrados, poderá verificar, através de serviço de terceiros, veracidade acadêmica, consulta profissional ou de reputação virtual, mas sem obrigação de fazê-lo.

14.4 - O site e aplicativo mobile do TERAPPIA poderá conter links com propagandas para outros sites, contudo não há nenhuma relação de qualquer ordem do TERAPPIA com essas outras instituições, não sendo responsável por eventuais danos, compras, vendas ou qualquer outro tipo de ônus ou bônus que cause aos seus usuários, bem como as suas políticas não são aplicáveis nesses casos. É de total responsabilidade do usuário os riscos de acesso desses sites de terceiros veiculados no TERAPPIA.

14.5 - O Psicólogo cadastrado, usuário ou anunciante concorda que o TERAPPIA não assume quaisquer responsabilidades por qualquer dificuldade técnica, bugs, queda de conexão, falhas no sistema, vírus ou trojans ou quaisquer tipos de defeitos ou danos ocorridos nos recursos computacionais ou de telefonia dos usuários ou de terceiros que possam ter acontecido por uso da plataforma, assim como custos referentes a gastos com telefonia móvel, sendo de inteira responsabilidade do usuário do TERAPPIA.

14.6 - Caso a plataforma fique offline, ou impossibilitada de uso, por mais longo que seja o período e por qualquer que seja o motivo, o psicólogo cadastrado, usuário ou anunciante aceita e concorda que sob nenhuma hipótese poderá exigir do TERAPPIA sua reativação ou mesmo qualquer tipo de indenização ou reparação de danos durante o período em que o site ou aplicativo estiverem offline, independente do motivo.

14.7 - Quaisquer alterações nas características ou forma de operação do site ou do aplicativo mobile, motivado por força maior, deverá ser interpretado e compreendido pelos usuários como tentativa de resolução de problemas pelo TERAPPIA, e o psicólogo cadastrado, usuário ou anunciante, aceita e concorda que não caberá sob nenhuma hipótese o direito a reclamações ou pleitos.

14.8 - Caso haja exigência de algum órgão governamental ou autoridade judicial, o TERAPPIA tem o direito de cooperar com qualquer tipo de investigação, podendo a qualquer momento, ceder informações disponíveis de psicólogos cadastrados ou anunciantes, e todos os Psicólogos, anunciantes e usuários concordam que não há qualquer possibilidade de impedir o fornecimento dessas informações a tais órgãos ou autoridades.

15 - SOBRE OS DIREITOS AUTORAIS E VEDAÇÕES

15.1 - Não é permitido por nenhum Psicólogo, anunciante ou usuário copiar, adaptar, vender, reproduzir, licenciar ou publicar dados ou quaisquer outras informações produzidas pelo TERAPPIA e publicadas no site ou aplicativo, para qualquer finalidade em qualquer meio de comunicação não autorizado pelo TERAPPIA, em quaisquer que sejam as modalidades, sejam essas online ou offline. Caso seja constatado tal tipo de infração ou reprodução de conteúdo do TERAPPIA em qualquer outro tipo de meio de comunicação não autorizado, o TERAPPIA irá exigir direitos autorais, bem como responsabilizar judicialmente o autor por tais atos indevidos, cabendo às sanções previstas nas leis.

15.2 - Da mesma forma, os Psicólogos autores de artigos, devem citar fontes, quando utilizados materiais produzidos por outros autores, sendo os Psicólogos, os únicos responsáveis pelo conteúdo publicado em formato de artigo na plataforma, e qualquer violação de direitos autorais, o Psicólogo será responsabilizado integralmente e responderá de acordo com as leis protetoras de direitos autorais, sem qualquer envolvimento do TERAPPIA.

15.3 - No TERAPPIA, os Psicólogos podem produzir materiais por meio das ferramentas desenvolvidas e oferecidas pela plataforma aos profissionais, com a finalidade de permitir ao TERAPPIA utilizar esses materiais para divulgação nos meios de comunicação aplicáveis e definidos por critério exclusivo da plataforma. Os Psicólogos concordam, por meio destes Termos de Uso, que todo material criado pelo usuário da plataforma, passa a ser de inteiro domínio do TERAPPIA, sendo o seu uso livre e irrestrito, independente da vigência ou não da assinatura do Psicólogo na plataforma. O Psicólogo concorda que o TERAPPIA tem direitos plenos e totais de exercício quanto à utilização dos materiais criados pelos profissionais para a finalidade de divulgação, incluindo-se também o direito de eliminação ou exclusão do material. Não é vedado ao Psicólogo criador do conteúdo, compartilhar, divulgar ou utilizar os seus próprios materiais em quaisquer meios de comunicação, durante a vigência da assinatura ou mesmo depois da cessão dos serviços da plataforma, por término do período de assinatura ou qualquer outro motivo.

15.4 - TERAPPIA é protegido por leis de propriedade intelectual e outras leis aplicáveis. Os Psicólogos, anunciantes e usuários concordam em respeitar tais leis e não copiar, reproduzir, modificar ou criar obras derivadas baseadas na plataforma, no aplicativo ou em qualquer parte dos serviços oferecidos pelo TERAPPIA. O uso não autorizado de materiais exclusivos da plataforma pode resultar em violação de leis de direitos autorais, marcas comerciais, privacidade e publicidade e outras leis aplicáveis.

16 - SOBRE O CANCELAMENTO DE CADASTRO DO PSICÓLOGO OU ANUNCIANTE

16.1 - O Psicólogo ou anunciante concorda por esses Termos de Uso da plataforma, que o valor pago ao TERAPPIA é referente à inscrição e cadastramento do profissional na plataforma pelo período selecionado previamente pelo próprio, onde ele poderá usufruir dos serviços oferecidos de acordo com o pacote de benefícios em vigência.

16.2 – Os Psicólogos e anunciantes cadastrados na plataforma poderão solicitar ao TERAPPIA, a qualquer momento, o cancelamento da sua assinatura ou exclusão cadastral. Contudo, o Psicólogo ou anunciante concorda que o procedimento de cancelamento cadastral no TERAPPIA deverá obedecer às especificações das cláusulas 16.3 e 16.4.

16.3 - De acordo com o artigo 49 do Código de Defesa do Consumidor (CDC), o Psicólogo ou anunciante tem o direito de solicitar a desistência da assinatura no prazo de 7 dias a contar do início da vigência da assinatura na plataforma, independentemente do período de assinatura escolhido. Nesse caso, o TERAPPIA devolverá o valor integral do produto adquirido.

16.4 – Caso o cancelamento da assinatura seja solicitado após o prazo de 7 dias especificado na cláusula 16.3, por cordialidade do TERAPPIA, haverá uma devolução proporcional de 25% do valor correspondente aos meses completos restantes do período contratado. Não haverá devolução proporcional pelos dias restantes do mês em que o cancelamento foi solicitado.

16.5 - A devolução proporcional será calculada com base no valor original da assinatura contratada, não incluindo juros de parcelamento ou taxas adicionais cobradas por bancos ou administradoras de cartão de crédito. O TERAPPIA não se responsabiliza por esses encargos adicionais, e a devolução será feita apenas sobre o valor original da assinatura.

16.6 - Caso, algum Psicólogo ou anunciante seja excluído da plataforma, por iniciativa do TERAPPIA, pelos motivos passíveis de exclusão, firmados e aceitos nesses Termos de Uso, o TERAPPIA não irá ressarcir nenhum valor pago, proporcional ou não ao período de assinatura escolhido pelo Psicólogo ou anunciante. O TERAPPIA também não é obrigado a fazer nenhum comunicado, aviso ou solicitar consentimento prévio ao Psicólogo ou anunciante excluído da plataforma, por descumprimento das regras contidas nesses Termos de Uso.

17 - SOBRE A RENOVAÇÃO DA ASSINATURA DO USUÁRIO

17.1 - Conforme previamente citado neste documento, o TERAPPIA cobra de seus usuários uma taxa anual ou semestral para inscrição de psicólogos na plataforma, e que esta, permite a vigência de acordo com o período selecionado pelo Psicólogo, contados a partir da publicação online do perfil do Psicólogo no TERAPPIA. Salvo à ocorrência de exclusão cadastral, pelos motivos citados neste documento, o TERAPPIA se comunicará com o psicólogo cadastrado, com o objetivo de lhe consultar e saber se há interesse em renovar a sua assinatura com o TERAPPIA, já que não há nenhuma forma de renovação automática em nossos sistemas. Caso o psicólogo tenha interesse, o TERAPPIA irá orientar o profissional em cada etapa até que seja completado o procedimento de renovação, onde o psicólogo permanecerá pelo novo período de assinatura adquirido. Em caso de não interesse, todos os dados do Psicólogo são excluídos automaticamente da base de dados do TERAPPIA após 90 (noventa) dias.

17.2 - Em caso de não haver resposta por parte do profissional quando este for consultado pelo TERAPPIA sobre o interesse na renovação da assinatura, o cadastro do profissional será descontinuado da plataforma na data de término da vigência da sua assinatura e não caberá ao psicólogo nenhum questionamento sobre tal ação da plataforma. Ainda assim, a assinatura poderá ser renovada e o perfil será reativado na plataforma apenas quando todos os procedimentos de publicação forem concluídos, incluindo-se a efetivação e confirmação de pagamento da assinatura.

17.3 – A renovação da assinatura, realizada até a data limite de expiração da assinatura vigente, garante que todas as informações do perfil do Psicólogo, bem como os comentários realizados por usuários e a publicação do perfil nas redes sociais, sejam mantidos intactos. Caso o Psicólogo não renove sua assinatura até a data de expiração, o perfil será removido da plataforma, juntamente com todos os demais dados e comentários dos usuários. Após 90 dias, todas essas informações serão permanentemente excluídas da base de dados do TERAPPIA.

17.4 – Caso o Psicólogo manifeste interesse em retornar ao TERAPPIA dentro do período de 90 dias após a exclusão do seu perfil na plataforma, independentemente do motivo, apenas os dados do perfil e os dados de acesso à conta serão restaurados para a nova assinatura. Os dados referentes aos comentários realizados por usuários não serão restaurados em nenhuma circunstância. Uma nova publicação nas redes sociais poderá ser feita para apresentar o Psicólogo novamente.

17.5 - O TERAPPIA se reserva no direito de avaliar unilateralmente a conduta do profissional durante o período de assinatura, bem como se coloca no direito de optar pela não renovação de um determinado profissional, caso o TERAPPIA conclua e decida não ter interesse. Nesse caso, não caberá ao psicólogo saber o motivo ou fazer qualquer questionamento, ou ainda, tentar criar recurso ou justificativa para reverter a decisão do TERAPPIA, restando apenas a exclusão cadastral do psicólogo, sem o direito de retorno futuro por bloqueio cadastral, independentemente do tempo transcorrido entre a saída e um possível interesse de reingresso por parte do psicólogo.

18 - SOBRE OS CANAIS DE CONTATO

18.1 - O TERAPPIA oferece aos seus usuários um canal de contato para o envio de dúvidas, sugestões, denúncias ou reclamações. O TERAPPIA não é obrigado a atender todos os pleitos de seus usuários, contudo, todas as informações serão analisadas a fim de buscar esclarecimentos ou avaliar a veracidade, apurando fatos e tomando medidas cabíveis. O TERAPPIA solicita, em seu formulário de contato, dados como NOME, SOBRENOME, TELEFONE E E-MAIL, unicamente utilizados para que o usuário autor do contato receba sua resposta, e dessa forma, o usuário está de pleno acordo em ceder tais informações para essa finalidade, sabendo que estes dados são automaticamente excluídos após a resposta.

18.2 - O atendimento da equipe de Suporte do TERAPPIA é realizado 100% por humanos e segue um horário de atendimento pré-estabelecido, que é informado no próprio canal de contato. O Psicólogo entende e concorda que o atendimento poderá ocorrer apenas dentro desses horários.

18.3 - O TERAPPIA valoriza o respeito e a educação em todas as interações realizadas por meio de seu canal de suporte. Qualquer comportamento desrespeitoso ou inadequado por parte do psicólogo será analisado pela Administração do TERAPPIA, podendo resultar em penalidades, incluindo a possível exclusão do profissional da plataforma por má conduta.

19 - SOBRE OS TERMOS DE USO

19.1 - Estes Termos de Uso constituem o acordo integral entre o TERAPPIA e os usuários da plataforma, e substituem quaisquer acordos ou entendimentos anteriores, sejam verbais ou escritos, relacionados ao assunto. Caso qualquer disposição destes Termos de Uso seja considerada inválida ou inexequível, tal disposição será eliminada ou limitada na medida mínima necessária para que estes Termos de Uso permaneçam em pleno vigor e efeito. A falha do TERAPPIA em exercer ou fazer cumprir qualquer direito ou disposição destes Termos de Uso de forma imediata, não constituirá uma renúncia do TERAPPIA a exercer tal direito ou disposição.

19.2 - Os usuários da plataforma concordam que qualquer disputa decorrente ou relacionada a estes Termos de Uso ou ao uso da plataforma será regida pelo foro da Comarca da Capital do Estado do Rio de Janeiro para dirimir eventuais questões oriundas destes Termos de Uso, com renúncia expressa de qualquer outro por mais privilegiado que seja ou porventura tenham ou venham a ter, e renunciando a qualquer outra jurisdição que possa ter direito por domicílio ou qualquer outra razão.

19.3 - Em caso de dúvidas sobre os Termos e Condições de Uso, os usuários da plataforma poderão entrar em contato com o TERAPPIA por meio dos canais de comunicação disponíveis na plataforma.
